Official Rules and Regulations
Raffle tickets are offered at $100.00 per ticket and are obtainable through this website.
Our goal is to issue 5,000 tickets. Once we issue 5,000 tickets, all entrants will be notified via the official website of the time and date and location of the raffle drawing. Additionally the winner will be notified via U.S. Certified mail and must claim the prize in accord with these rules as set forth more fully above. In the event we have not met our goal of the sale of 5,000 tickets by May 30th 2010, which closes the sale of tickets the total sum of U.S. dollars collected for sold tickets shall be converted into a 50/50 raffle drawing in which 50% of all the ticket proceeds goes to one (1) winner in accord with the same rules as applied to the raffle and the remaining 50% goes to the charity whom will be responsible for all administrative cost in connection with the operation of the raffle. Either way, everyone will have an opportunity to win a great prize!
The drawing will be held once we reach our goal of 5,000 tickets or by May 30, 2010, whichever may come first with official updated notifications posted on the official web site ( www.PalmBeachHomeRaffle.com ).
By entering into this game of chance all entrants agree to be fully and unconditionally bound by these official rules and regulations, waive any right to claim ambiguity in the raffle or these official rules and regulations and further agree to be bound by the sponsors decisions and interpretation of these official rules and regulations. By entering all entrants release the participating sponsors and providers and any of their respective parent companies, subsidiaries or affiliates, directors, officers, employees and agencies from any and all liability.
ELIGIBILITY
Drawing open to participants who are 18 years of age or older at the time of entry, to obtain a ticket, or be a ticket holder or to win the prize. An affidavit of eligibility, photo identification, taxpayer identification number and other information will be required of the raffle winner. Void where prohibited. This is not a lottery; this is a drawing by chance. All applicable federal, state and local laws and ordinances apply. The sponsors are obligated to report the value of the prize to tax authorities as income.
HOW TO OBTAIN A TICKET
Tickets may be obtained online (using secure checkout), phone order or by mail (certified check or money order). All entrants must provide a valid email address, full legal name, home phone number, alternate phone number, physical mailing address, and/or mailing address. Tickets and payment confirmation will be sent electronically via email and or US Mail. No refunds are available except where noted and all ticket sales are final. Any ticket request will be rejected if the credit card used to purchase said ticket is not honored.
TAXES
The IRS has decided that amounts paid for chances in raffles, lotteries, or similar drawings for prizes are not gifts, and do not qualify as tax deductible charitable contributions. A W-9 form must be completed by the winner. Any with holdings if required, applicable to prize will be required at the time of transfer of such prize to the winner. All State, Federal and local taxes associated with the receipt of the prize, including and without limitation, all applicable sales, use, luxury, income and special taxes are the sole responsibility of the owner (winner).
CLAIM OF PRIZE
Winner must claim their prize within thirty (30) days of the drawing and sign a completed W-9 form or other forms as required by law and the IRS. No substitutions or changes. Prize is not transferable. No entrant need be present at drawing or tour the home to win. Winner is determined by random drawing. Winner must produce two (2) forms of valid picture identification to claim prize. Winner will be notified within five (5) days of actual drawing by telephone, mail or email and will be posted on the front page of this website. Rights are reserved to disqualify entries not in conformity with the rules and regulations hereof.
The Sponsors are not responsible for any printing errors in any raffle related materials or for lost, late or miss delivered or non delivered mail or for any other failure to receive orders or deliver receipts prior to the drawing deadline. All entries become the property of the game and will not be returned.
METHOD OF RANDOM DRAWING (added for increased security)
Each eligible entry is assigned a unique water marked 5 digit ticket, numbered ranging from 0001-5000. Five balls will be mechanically selected at random by a machine supplied by a certified professional vendor. The entry that matches all five balls in order will be declared the winner. In the event that a combination is drawn that does not correspond with any ticket sold, the entire process will be repeated until a winning combination is drawn. Witnesses will be chosen from the audience to view the pulled ping pong balls. The accounting firm that will represent the sponsor will also be present to validate the drawing.
SELECTION OF WINNER
The winning numbers will be selected mechanically by services of a professional vendor and said drawing shall be supervised and certified by the independent accounting firm. Entrants need not be present to win. The winner assumes all fees and taxes as of the date of transfer. All fees for transfer including title insurance, closing, legal (on behalf of seller), and documentary transfer fees shall be paid by the sponsor. There are no warranties expressed or implied that accompany this prize. The home is granted on an "as is" basis with no guaranties or warranties. Winner must execute all required documentation to transfer title within thirty (30) days of the drawing of the winning ticket and notification of the winner thereof. Winner grants permission for the use of their name and likeness/photograph without compensation for advertising of this and similar promotions, unless prohibited by law. In the event the winner is found ineligible under these rules and regulations, an alternate drawing will be held within ten (10) business days of said determination and notification thereof will be posted on the website immediately.
GENERAL TERMS AND CONDITIONS
Void where prohibited by law. By entering this drawing, the entrant agrees to be bound by these rules and regulations and the decisions of the sponsors shall be final. Winners will be required to execute an affidavit of eligibility and a publicity release permitting the raffle sponsors to use their name, photograph, likeness and voice for promotional use and purpose in any media. All winners are required to provide proof of identity satisfactory to the sponsor in their sole discretion that matches the number on the winning water marked ticket which is matched to the original application of purchase by the sponsor. Neither the sponsor's, nor any of their subsidiaries, affiliated companies, franchises, service agencies, officers, directors, shareholders, members, representatives, or independent contractors or any of its affiliates are responsible for any injuries, losses or damages of anything arising in connection with or as a result of the winner's acceptance or use of the prize. No purchase necessary. Winner agrees to defend, indemnify and hold harmless any service provider and/or sponsors and each and every one of the directors, officers, shareholders, employees, agents and affiliates and identities from any and all losses, damages, rights, claims and actions of any kind arising in connection with or as a result of the winner's acceptance and use of the prize. If due to circumstances beyond our control incur, including acts of God (fire, storm damage etc.), we will then return all monies previously paid to the depositor with no further liability or recourse.

ALL PERSONAL INFORMATION COLLECTED BY AND DURING THE RAFFLE WILL BE USED FOR ADMINISTRATION OF THE RAFFLE. NEITHER THE RAFFLE SPONSORS, NOR THE CHARITABLE ORGANIZATION WILL SHARE, SELL OR OTHERWISE DISTRIBUTE PERSONAL INFORMATION COLLECTED BY SPONSOR EXCEPT AS STATED ABOVE.
